Nonprofit Issues® and the Philadelphia law firm of Montgomery, McCracken, Walker & Rhoads will present the 19th annual “This Year In Nonprofit Law” on Thursday, December 3, 2009.
The format will follow the successful programs of recent years. In the first session, our panel of lawyers who deal with nonprofit legal issues every day will review the most important legal developments for nonprofits during the last year, including:
- the Sen. Fumo trial and its aftermath;
- the impact of the new Form 990;
- a new case illustrating the difficulties with indemnification clauses;
- developments on state taxes and charitable registration laws;
- the top issues facing Congress;
- and much more.
In the second session, Sharon Ward of the Pennsylvania Budget and Policy Center and David Ross of the Pennsylvania Association of Nonprofit Organizations will explain the Pennsylvania budget debacle and the serious damage to charities: how it happened, who got hurt, and what can be done to prevent it from happening again.
The first round of afternoon break-out sessions will include:
- a review of strategic alliances: how and why they should be accomplished;
- top 10 issues in administering charitable trusts and other gifts;
- an update in employee benefit issues.
The second round will include:
- the art and science of drafting bylaws to avoid ambiguities and reduce the risks of litigation;
- ethical issues for nonprofit lawyers;
- an update on employment law, covering disciplinary issues, termination, layoffs and severance pay.
For those attending the bylaw session, you may submit your organization’s bylaws to be shared with the group for critique of some good and bad points during the discussion.
The program provides 5 hours of continuing education credit for Pennsylvania lawyers, including an hour of ethics credit for those attending the ethics session. We also provide 5 hours of CPE for Pennsylvania accountants.
Participants will receive a new or renewed one-year subscription to the electronic version of Nonprofit Issues, plus a notebook of articles, outlines and other citations. The program starts at 9 a.m. and runs to 3:45. The registration fee is $155 for the first participant from an organization and $85 for each additional registrant.
Lawyers requesting Pennsylvania CLE credit must pay an additional $10 for processing.
Register now, space is limited. Last year we were forced to place some registrants on a waiting list.
The program will be held in the firm’s offices at 123 S. Broad Street, Philadelphia.
